2.    The data we collect about you

Personal data, or personal information, means any information about an individual from which that person can be identified. It does not include data where the identity has been removed (anonymous data).

We may collect, use, store and transfer different kinds of personal data about you which we have grouped together as follows:

Identity Data: includes first name, maiden name, last name, username or similar identifier, job title and organisation.

Contact Data: includes delivery address, email address and telephone numbers.

Technical Data: includes internet protocol (IP) address, your login data, browser type and version, time zone setting and location, browser plug-in types and versions, operating system and platform, and other technology on the devices you use to access this website.

Profile Data: includes your username and password, purchases or orders made by you, your interests, preferences, feedback and survey responses.

Includes details about your race or ethnicity, religious or philosophical beliefs, sex life, sexual orientation, political opinions, trade union membership, information about your health (such as whether you have a disability), genetic and biometric data, and information about criminal convictions and offences.

We do not intentionally collect Special Categories of personal dataabout you. However, we may in rare circumstances process Special Categories of personal data about you if, in using our website, you choose to create or post content which contains Special Categories of personal data. Posting this information is entirely optional and is only done by you voluntarily with your full knowledge and sole involvement. As set out in our Terms of Use, you must not create or post content which contains Special Categories of personal data of other people.

If you fail to provide personal data

Where we need to collect personal data by law, or under the terms of a contract we have with you, and you fail to provide that data when requested, we may not be able to perform the contract we have or are trying to enter into with you (for example, to provide you with goods or services). In this case, we may have to cancel a product or service you have with us but we will notify you if this is the case at the time.

Applying to work with us (if you are applying to work with us as an employee, worker or contractor)

In connection with your application to work with us, we will collect, store and use the following categories of personal information about you:

  • The information you have have provided to us in your curriculum vitae and covering letter.
  • The information you have provided in your covering letter, including name, title, address, telephone number, personal email address, date of birth, gender, employment history, qualifications.
  • Any information you provide to us during an interview.
  • Any results of competency tasks you may complete as part of the interview process.

We may also collect, store and use the following types of more sensitive personal information:

We collect personal information about candidates from the following sources:

Marketing

We will use the personal information we collect about you to:

  • Communicate with you about the recruitment process.
  • Keep records related to our hiring processes.
  • Comply with legal or regulatory requirements.

It is in our legitimate interests to decide whether to appoint you to work or role you for which you are applying since it would be beneficial to our business to appoint someone to that work or role you for which you are applying.

We also need to process your personal information to decide whether to enter into a contract of employment or contract for services (as applicable to the work or role for which you are applying) with you.

Having received your CV and covering letter, we will then process that information to decide whether you meet the basic requirements to be shortlisted for the role. If you do, we will decide whether your application is strong enough to invite you for an interview. If we decide to call you for an interview, we will use the information you provide to us at the interview to decide whether to offer you the work or role you for which you are applying. If we decide to offer you the work or role you for which you are applying, we will then take up references before confirming your appointment or engagement (as applicable to the work or role for which you are applying.)

If you fail to provide personal information when applying to work with us

If you fail to provide information when requested, which is necessary for us to consider your application (such as evidence of qualifications or work history), we will not be able to process your application successfully. For example, if we require references for this role and you fail to provide us with relevant details, we will not be able to take your application further.

5.    Disclosures of your personal data

We may share your personal data with the parties set out below for the purposes set out in the table above:

our suppliers which may include IT providers of cloud based hosting and technical infrastructure, CRM and marketing software;

providers who collect information on our behalf, including as necessary to operate features of our website, such as cloud based log aggregators, customer satisfaction surveys, as well as analytics, performance, tracking, and advertising partners;

professional advisers including consultants, lawyers, bankers, auditors and insurers who provide consultancy, banking, legal, insurance accounting and other services;

our trusted business partners who we work with;

HM Revenue & Customs, regulators and other authorities based the UK who require reporting of processing activities in certain circumstances; and

third parties (including affiliates of such third parties) to whom we may choose to sell, transfer or merge parts of our business or our assets or who may seek to invest in our business or assets (or with whom we may enter into negotiations, in respect of any such activities). Alternatively, we may seek to acquire other businesses or merge with them. If a change happens to our business, then the new owners may use your personal data in the same way as set out in this Privacy and Cookie Policy.

We require all third parties to respect the security of your personal data and to treat it in accordance with the law. We do not allow our third-party service providers to use your personal data for their own purposes and only permit them to process your personal data for specified purposes and in accordance with our instructions.

When you apply to work with us, we will only share your personal information with the following third parties for the purposes of processing your application: other parties within our group and service providers.

6. International transfers

We share your personal data with third parties that are based outside of the UK, so their processing of your personal data will involve a transfer of data outside the UK. Whenever we transfer your personal data out of the UK, we ensure a similar degree of protection is afforded to it by ensuring at least one of the following safeguards is implemented:

We will only transfer your personal data to countries that have been deemed to provide an adequate level of protection for personal data; or

We may use specific contracts approved for use in the UK which give personal data the same protection it has in the UK.

7.      Data security

We have put in place appropriate security measures to prevent your personal data from being accidentally lost, used or accessed in an unauthorised way, altered or disclosed. They will only process your personal data on our instructions and they are subject to a duty of confidentiality.

We have put in place procedures to deal with any suspected personal data breach and will notify you and any applicable regulator of a breach where we are legally required to do so.

How we use Special Categories of Personal Data

We will use your Special Categories of Personal Data (as defined above) in the following ways:

  • We will use information about your disability status to consider whether we need to provide appropriate adjustments during the recruitment process, for example whether adjustments need to be made during a test or interview.
  • We will use information about your race or national or ethnic origin, religious, philosophical or moral beliefs, or your sexual life or sexual orientation, to ensure meaningful equal opportunity monitoring and reporting.

Where you provide information to us about your race or ethnicity, religious or philosophical beliefs, trade union membership, sexual orientation, political opinions, your health, and criminal convictions, allegations, proceedings and offenses which relate to you, this is subject to special protection under UK law. Where we collect, use and share your Special Categories of Personal Data in cases where UK data protection laws apply, it relies upon one or more of the following legal bases:

  • with your consent, which you may revoke at any time;
  • where we need to carry out our legal obligations or exercise rights in relation to your employment with us. This is our appropriate policy document explaining safeguards which we are required by law to maintain when processing such data and this processing is justified on the basis of paragraph 1 (Employment, social security and social protection) of Schedule 1 to the UK Data Protection Act 2018;
  • where it is needed due to substantial public interest, such as for ensuring equal opportunities or in relation to our occupational pension scheme or preventing or detecting an unlawful act. This is our appropriate policy document explaining safeguards which we are required by law to maintain when processing such data and this processing is justified on the basis of paragraphs 8 (Equal opportunity of treatment), 9 (Racial and ethnic diversity at senior levels of organisations) and/or 10 (Preventing or detecting unlawful acts) of Schedule 1 to the UK Data Protection Act 2018;
  • to establish, exercise or defend legal claims; or
  • where the information has already been made public by you.

To protect your Special Categories of Personal Data we have put in place procedures to ensure that we:

  • check the accuracy of Special Categories of Personal Data we collect and correct it where necessary;
  • minimise the amount of Special Categories of Personal Data we collect; and
  • periodically review any Special Categories of Personal Data we have obtained so that any such information can be deleted when it is no longer required.

8.    Data retention

How long will you use my personal data for?

We will only retain your personal data for as long as reasonably necessary to fulfil the purposes we collected it for, including for the purposes of satisfying any legal, regulatory, tax, accounting or reporting requirements. We may retain your personal data for a longer period in the event of a complaint or if we reasonably believe there is a prospect of litigation in respect to our relationship with you.

To determine the appropriate retention period for personal data, we consider the amount, nature and sensitivity of the personal data, the potential risk of harm from unauthorised use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and the applicable legal, regulatory, tax, accounting or other requirements.

By law we have to keep basic information about our customers (including Contact and Identity Data) for six years after they cease being customers for tax purposes.

When you apply to work with us we will retain your personal information for a suitable period of time after we have communicated to you our decision about whether to appoint you to the role or the work for which you have applied. We retain your personal information for that period so that we can show, in the event of a legal claim, that we have not discriminated against candidates on prohibited grounds and that we have conducted the recruitment exercise in a fair and transparent way. After this period, we will securely destroy your personal information in accordance with applicable laws and regulations.

In some circumstances we will anonymise your personal data (so that it can no longer be associated with you) for research or statistical purposes, in which case we may use this information indefinitely without further notice to you.

No fee usually required

You will not have to pay a fee to access your personal data (or to exercise any of the other rights). However, we may charge a reasonable fee if your request is clearly unfounded, repetitive or excessive. Alternatively, we could refuse to comply with your request in these circumstances.

What we may need from you

We may need to request specific information from you to help us confirm your identity and ensure your right to access your personal data (or to exercise any of your other rights). This is a security measure to ensure that personal data is not disclosed to any person who has no right to receive it. We may also contact you to ask you for further information in relation to your request to speed up our response.

Time limit to respond

We try to respond to all legitimate requests within [one month]. Occasionally it could take us longer than a month if your request is particularly complex or you have made a number of requests. In this case, we will notify you and keep you updated.

LAWFUL BASIS

Legitimate Interest means the interest of our business in conducting and managing our business to enable us to give you the best service/product and the best and most secure experience. We make sure we consider and balance any potential impact on you (both positive and negative) and your rights before we process your personal data for our legitimate interests. We do not use your personal data for activities where our interests are overridden by the impact on you (unless we have your consent or are otherwise required or permitted to by law). You can obtain further information about how we assess our legitimate interests against any potential impact on you in respect of specific activities by contacting us.

Performance of Contract means processing your data where it is necessary for the performance of a contract to which you are a party or to take steps at your request before entering into such a contract.

Comply with a legal obligation means processing your personal data where it is necessary for compliance with a legal obligation that we are subject to.

YOUR LEGAL RIGHTS

You have the right to:

  • Request access to your personal data (commonly known as a “data subject access request”). This enables you to receive a copy of the personal data we hold about you and to check that we are lawfully processing it.

  • Request correction of the personal data that we hold about you. This enables you to have any incomplete or inaccurate data we hold about you corrected, though we may need to verify the accuracy of the new data you provide to us.

  • Request erasure of your personal data. This enables you to ask us to delete or remove personal data where there is no good reason for us continuing to process it. You also have the right to ask us to delete or remove your personal data where you have successfully exercised your right to object to processing (see below), where we may have processed your information unlawfully or where we are required to erase your personal data to comply with local law. Note, however, that we may not always be able to comply with your request of erasure for specific legal reasons which will be notified to you, if applicable, at the time of your request.

  • Object to processing of your personal data where we are relying on a legitimate interest (or those of a third party) and there is something about your particular situation which makes you want to object to processing on this ground as you feel it impacts on your fundamental rights and freedoms. You also have the right to object where we are processing your personal data for direct marketing purposes. However, this will not affect the lawfulness of any processing carried out before you withdraw your consent. If you withdraw your consent, we may not be able to provide certain products or services to you. We will advise you if this is the case at the time you withdraw your consent.

  • Withdraw consent where you applied to work with us. When you applied for this role, you provided consent to us processing your personal information for the purposes of the recruitment exercise. You have the right to withdraw your consent for processing for that purpose at any time. Once we have received notification that you have withdrawn your consent, we will no longer process your application and, subject to our retention policy, we will dispose of your personal data securely.
